Terms of Service

These Terms of Service apply to the use of the "padelturn" platform (hereinafter "Platform"), operated under the domain padelturn.com.

By registering and using the Platform, you accept these Terms of Service in their current version. If you do not agree with these terms, you may not use the Platform.

padelturn is an online platform for organising and managing padel tournaments and leagues. The Platform offers the following main features:

• Creation and management of padel tournaments in various formats (single elimination, round robin, Americano, Mexicano, Beat the Box, double elimination, Swiss system)
• Player and team registration via join code, link or CSV import
• Automatic schedule and bracket generation
• Live scoring with confirmation workflow
• Public spectator views for viewers
• In-app chat for tournament participants and organisers
• League system with continuous rankings
• Club management with co-admin roles
• Player profiles with statistics and history

3.1 Registration

A registration is required to use the Platform. You undertake to provide truthful and complete information when registering.

3.2 Access credentials

You are obliged to keep your access credentials (email and password or magic-link token) confidential and to protect them from third-party access. We must be informed immediately if abuse is suspected.

3.3 Liability for account misuse

You are liable for all activities carried out under your user account, unless the misuse is not attributable to you.

4.1 Permitted use

The Platform may only be used for the organisation of and participation in padel tournaments and leagues. Commercial use is permitted only with prior written consent.

4.2 Prohibited activities

It is prohibited to:

• Use the Platform for unlawful purposes
• Harass, threaten or discriminate against other users
• Submit false or misleading information
• Use the Platform via bots, scripts or other automated means unless expressly permitted
• Bypass or manipulate security mechanisms
• Infringe copyrights or other protective rights
• Send spam, offensive or inappropriate content (including in the in-app chat)
• Use other users' data outside the Platform without their consent

5.1 Responsibility of the organiser

As tournament organiser, you are responsible for the proper running of your tournament, including compliance with applicable rules and regulations and the substantive correctness of all entered and finalised results.

5.2 Tournament content

You are responsible for all content you publish in connection with your tournament (tournament name, description, rules, chat messages, imported player lists). This must comply with applicable laws and must not violate the rights of third parties.

5.3 Player data and CSV import

When processing player data — particularly during CSV bulk import — applicable data protection regulations must be observed. You undertake to use the data only for tournament-related purposes and to obtain any required consents from affected players in advance.

5.4 Public spectator views

By creating a tournament or joining as a player, you consent to your player name, match pairings and match results being viewable through the publicly accessible spectator view of the respective tournament.

Notice: padelturn is currently under active development. New features are continuously being added, existing ones may change or be temporarily unavailable. Software bugs, malfunctions, data loss and unexpected behaviour are possible.

We strive to ensure the highest possible availability of the Platform, but cannot guarantee 100% availability. Maintenance work and technical disruptions may lead to temporary outages.

We reserve the right to temporarily or permanently modify, expand or discontinue the Platform or parts of it.

7.1 Use at your own risk

Use of the Platform is expressly at your own risk. You are aware that padelturn is a software platform whose features may contain errors, inaccuracies or outages.

7.2 Disclaimer for software errors

We accept no liability for errors or inaccuracies in the software, including in particular:

• Faulty bracket generation or schedule creation
• Incorrect or missing point or score calculations
• Incorrect rankings, statistics or win-rate calculations
• Errors during CSV import of player lists
• Errors in the delivery of match notifications or emails
• Delays or outages of the live score system
• Malfunctions or data loss in the chat

Organisers and players are required to independently verify match results, brackets and final standings for correctness before any official announcement. Liability for damages arising from a software malfunction (e.g. trophies wrongly awarded, incorrect seeding in subsequent tournaments) is excluded.

7.3 Data loss

We recommend regular backups of your data. Liability for data loss is excluded unless caused by gross negligence or intent.

7.4 User behaviour

We accept no liability for the behaviour of other users or for damages arising from participation in tournaments (e.g. injuries during play, disputes between players, incorrect entries by other participants).

7.5 General scope of liability

Otherwise, we are only liable for damages caused intentionally or by gross negligence. Liability is limited to the typically foreseeable damages. Liability under the German Product Liability Act, for injury to life, body and health, and in the event of an assumed warranty remains unaffected.

All content of the Platform (software, design, texts, graphics, etc.) is protected by copyright. Any use beyond the intended use of the Platform is prohibited.

By uploading content (avatars, tournament descriptions, chat messages, CSV lists), you grant us the simple, non-exclusive right to use, store and process this content within the framework of the Platform.

9.1 Ordinary termination

You may delete your user account at any time without giving reasons. We may terminate the user relationship with a notice period of 30 days.

9.2 Extraordinary termination

We reserve the right to suspend or delete user accounts without notice in the event of a violation of these Terms of Service.

We reserve the right to amend these Terms of Service. Changes will be communicated to you by email or via the Platform. They are deemed approved if you do not object within 4 weeks of notification.

You are entitled to extraordinary termination in the case of material changes.

The collection and processing of personal data is carried out in accordance with our Privacy Policy, which forms part of these Terms of Service.

Should individual provisions of these Terms of Service be invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by an effective one that comes closest to the intended purpose.

These Terms of Service are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods.

The place of jurisdiction for all disputes is, to the extent permitted by law, the place of business of the Platform operator.
